AZMB Terms and Conditions
The following Terms and Conditions apply to all services offered by AZ Mama Bear Pet Care, LLC (“AZMB”, “Pet Sitter”, “Sitter” or “Company”) to the Customer (“Client”, “Owner” or “Pet Owner”) who signs this agreement.

 The terms of this document applies to all the pets owned by the Client, including any and all new pets that the Customer obtains on or after the date this document was signed, at any and all locations the owner designates for service.

 Pet Owner represents and warrants it is the valid owner of the pet receiving services from AZMB. AZMB does not provide services for “Visiting” pets that do not belong to the client without a separate set of forms, including Client Information, Terms and Conditions and the Veterinary Release Agreement, being filled out and signed by the rightful owner(s).

 A 35% Deposit is due at the time of booking any reservation. Reservations are not held until deposit in full is received by AZMB or other special arrangements are agreed upon in writing by both parties. Except for Dog Walking packages, which are paid for, in advance of services, at the beginning of the month.

 Cancellation Charge Policy:
Reservations:
o 7 Days prior to a reservation: Deposit is forfeited (14 Days for Sleep Overs)
o 8+ Days prior to a reservation: Deposit is refunded (15+ Days for Sleep Overs)
Holiday Reservations:
o 14 Days prior to a reservation: Deposit is forfeited (30 Days for Sleep Overs)
o 15+ Days prior to a reservation: Deposit is refunded (31+ Days for Sleep Overs)

 Additional services not yet performed may be cancelled at any time either prior to or during the reservation period.

 A sitter's availability is based upon the reservations they are booked for. Client is responsible for payment of the entire reservation except as set forth herein. If a reservation is shortened less than 7 days prior to the start of the reservation or due to the early return of the Owner, 35% of the cancelled services will still be billed to the Client to compensate sitter for loss of pay. Clients will not have to pay for any scheduled Additional Services (i.e. Bathing, Pet Taxi) not yet performed.

 There will be a $35 service charge for each returned check.

 Pet Owner is responsible for supplying the necessary safe equipment/supplies needed for the care of their pet(s), including but not limited to a sturdy, well-fit collar (halter, harness, etc.) for walks or in case of emergencies, firmly affixed vaccination and ID tags, a leash, pooper-scoopers, litter boxes, food, cleaning supplies, medicines, pet food and cat litter. Pet Owner authorizes AZMB to purchase any missing, necessary items to properly perform the Pet Sitters duties. Pet Owner agrees to be responsible for the payment of any such items, as well as the service fees for obtaining the items and will reimburse AZMB within 7 days of the purchases made.

 AZMB is unable to care for any pets with a history of aggressive behaviors. Pet Owner must divulge information on any pet that has displayed or engaged in aggressive behavior with another pet or person to AZMB prior to reservations.

 In the event my pet cause's injury and/or death to a person, or animal, while in the custody of AZMB, or causes excessive destruction of AZMB's property, pet owner assumes all responsibility both financial and legal, for the action(s) of their pet. Customer agrees to indemnify and hold harmless the Company from any such claim.

 Client agrees to notify AZMB of any concerns within 24 hours after the final service. AZMB is not responsible for any claims made more than 24 hours after the final service.

 Client agrees that any photos of the pet may be used in AZMB's marketing materials and on social media (website, Facebook, etc.). AZMB will do it's best to crop or blur out any identifying home markers before use. If client wishes for AZMB to not take any pictures of their pet (this will include all picture updates sent to the client as well), client must notify the front office in writing of their wishes.

 AZMB is authorized to pick up, drop off and transport the owner's pet to any grooming, veterinarian or other services as set up by Pet Owner. AZMB is also authorized to transport the pet to any veterinarian and/or emergency services deemed necessary by Pet Sitter. In the event of a vehicular accident, Pet Owner agrees to indemnify and hold harmless AZMB from any escape, injury or death sustained during the accident to the pet and will be responsible for all subsequent medical expenses.

 Owner specifically represents and warrants to AZMB that, to the best of Owner's knowledge, their pet has not been exposed to or diagnosed with any contagious diseases or parasites within a 30 day period prior to Boarding or Daycare check-in. Owner further agrees and will provide veterinarian verification that the pet is current on all vaccinations upon initial visit. AZMB requires canine pet(s) to be current on the Rabies, DHLPP (Distemper and Parvo) and Bordatella (Kennel Cough - Boarding/Daycare Only) vaccinations. Felines are required to be current on FVRCP (Distemper). If your feline is permitted outside, then AZMB also requires FeLV (Leukemia) and Rabies vaccinations.

 AZMB is authorized to seek any veterinarian assistance needed during a pet's reservation/service. Owner acknowledges that even though AZMB does everything within their power to ensure the pet's health during their absence, accidents, injuries, illness or death may be unavoidable. Stress related health issues may also occur due to the Owner's absence or from boarding in new surroundings. Owner is also aware that stress may cause dormant conditions to become active and any existing medical condition may become exacerbated. Owner further authorizes AZMB and Owner's primary veterinarian(s) to share each of their individual pet's medical records with the chosen veterinarian(s) in the interest of providing the best possible care for their ill or injured pet(s).

 In the event Owner's pet were to become ill, injured or if the state of the animal's health otherwise requires professional attention, AZMB in their sole discretion may engage the services of a veterinarian and administer any medicine or give other requisite attention to the animal as directed by the veterinarian. AZMB will make every effort to contact Owner prior to seeking medical attention, regarding any treatments, illness, injury or other potential problems as soon as the condition is deemed non-life threatening and/or contact is possible. AZMB is not responsible for the health and wellbeing of the pet while under the care of another service professional such as a veterinarian. Any expenses AZMB incurs for any and all veterinary services rendered, including but not limited to diagnosis, treatment, grooming, medical supplies, transportation and boarding, shall be paid by Owner to AZMB prior to the release of the pet or within 7 days of Owner's return.

 Pet Owner will be responsible for all medical expenses and damages resulting from an injury to the Pet Sitter, or other persons, by the Pet. Owner agrees to indemnify, hold harmless and defend AZMB, in the event of a claim by any person injured by the Owner's Pet.

 AZMB agrees to remain fully insured and bonded at all times.

 Owner authorize this contract to be valid approval for all future services permitting AZMB to accept all future phone, text, email or online reservations to care for my pet(s) and/or to enter my home without additional signed contracts or written authorizations. In the event a client's Primary Pet Sitter is unable to provide service(s), a Secondary or Backup Pet Sitter will be sent to perform service(s).

 AZMB agrees to provide services as stated in this agreement in a reliable, caring and trustworthy manner. The Client expressly waives and relinquishes any and all claims against AZMB and its employees, except those arising from gross negligence. Claims of negligence that involve a hired Independent Contractor, hired by AZMB, will be the responsibility of the Independent Contractor and the company they represent.

 AZMB reserves the right to end service and terminate this contract at any time if the Pet Sitter, in his/her sole discretion determines that the Owner or Owner's pet poses a danger to the health or safety of the Pet Sitter, itself, other pets or other people. If such concerns prohibit the Pet Sitter from caring for the pet, the Owner authorizes the pet to be placed in a kennel (or previously arranged locale), with all charges (including but not limited to transportation, kenneling, tranquilizing, treating, accessing and liability) to be the responsibility of the Owner. All keys in AZMB's possession will be returned to the Owner within a 14 day period either in person or by mail.



BOARDING AND DAYCARE CLIENTS:

 While it is our policy to maintain the safest environment possible; there is always a risk when allowing animals to interact freely with one another. Fights, scratches, cuts, injuries, etc. can happen while under the Pet Sitters supervision or when the pet is left alone within their secure area, such as a kennel. Pet Owner agrees to releases AZMB and associates from any legal claim regarding injury, illness or death during your pet's boarding or daycare stay unless the act was the result of the gross negligence or intentional act of AZMB or its employees or agents.

 All Client pickups and drop offs are scheduled by appointment only. Given the unique nature of our boarding/daycare service being in your Pet Sitter's personal home, same day pickup and drop off changes may not be available based on the Sitters schedule for the day. Be sure to contact your Sitter as soon as possible if you wish to change your time or are running late, to assess if your Sitter will be available. Please, keep in mind, your Sitter's are working with live animals and as such occasionally situations can arise causing them to be late for and/or need to cancel/reschedule said appointments.



VACATION HOME VISIT, DOG WALKING and SLEEP OVER CLIENTS:

 Pet Owner is responsible for pet-proofing the house, yard and any security fences/gates/latches. AZMB will not be responsible for the safety of any pets and will not be liable for the injury, disappearance, death, fines, damage caused by the pet to a person or property should the home/yard not be properly secured. AZMB is also not responsible for the health, wellbeing or fines incurred by any pet with unsupervised access to the outdoors (i.e. dog doors).

 AZMB is not responsible for wilted, dead or otherwise unhealthy plants. AZMB will work hard to follow your written directions as precisely as possible, but cannot be held responsible if the results are not favorable. Please place all indoor plants together on a waterproof surface in plain sight, as your pet sitter is not responsible for water damaged areas or missed plants.

 AZMB is not responsible for damage to the home caused by the Owner's pet. Owner understands, in their absence, pets may become destructive or “Act Out' due to the stress or boredom from an absent Owner. This includes, but is not limited to, damage to floors or walls, accidents in the home, damaged or destroyed personal items. In these situations, AZMB will contact the Owner to make them aware of any such issues and may even send pictures so the Owner may see the damage. AZMB will do its best to prevent any further damage in any way they deem appropriate.

 AZMB is not responsible for damage to the home beyond the control of the Pet Sitter. This includes, but is not limited to, leaks, electrical problems or acts of nature. In these situations, the AZMB will attempt to contact the customer and then the emergency contact before making a subjective decision on dealing with the problem. All repairs and related fees (including Sitters time and coordination fees) will be fully reimbursed to AZMB within 7 days.

 NO other service individuals (neighbors, family, workers, etc.) are permitted into the home or on property during the time AZMB is contracted for services. If other parties are allowed onto the Client's property, AZMB will not responsible for any Pet related issues including but not limited to loss or death of Pet, illness, injury, etc. AZMB also accepts no responsibility for the security of the premises, property damage to Client's or any other property and/or theft if other individuals, aside from AZMB, have access to Client's property or if the home is not properly secured.

 AZMB is not liable for any loss or damage in the event a burglary or other crime that should occur while under this contract unless it is proven to be caused by the negligent act of the Pet Sitter. Pet Owner agrees to secure home prior to leaving the premises. AZMB will re-secure the home to the best of its ability both during and at the end of each visit. While keys are in the possession of the Pet Sitter, they will either be on the Sitter's physical person or properly stored in an undisclosed location.

 It is suggested that arrangements be made with someone other than AZMB to evacuate pets in case of a natural disaster, weather related event or emergency. AZMB will do its best to see to your pet's safety should such events occur, but can't guarantee it and shall under no circumstances be responsible for the pet in the event of any such emergency. Owner specifically releases AZMB from any and all loss or injury resulting from any such act of god or emergency event.

 All Clients are required to provide 2 sets of keys (or a garage code/opener plus a key) to AZMB. One key or mode of entry will be given to your Primary Sitter and the other will be kept at AZMB's office as a backup in case of an emergency or Sitter change. Both sets of keys will be kept by AZMB unless Owner requests their return or service is cancelled. In which case, all keys in AZMB's possession will be returned to the Owner within a 14 day period either in person or by mail. Owner also authorizes AZMB to make a duplicate copy of the keys should they deem them necessary to accommodate multiple Pet Sitters who regularly serve their pets.

 In the event a client's Primary Pet Sitter is unable to provide any scheduled service(s), a Secondary or Backup Pet Sitter will be sent to perform said service(s) to ensure pet's health and wellbeing.



 This agreement is valid from the date signed, and replaces any prior Terms and Conditions between the parties. These terms and conditions may be modified by AZMB at any time. The revised terms and conditions will be relayed to the Client either verbally or via the client portal, text, mail or email. Client agrees to abide by any future AZMB term changes.

 The owner states that he/she has read this agreement in its entirety and fully understands and accepts its terms and conditions.
